VibePoints — Website Terms of Use

Plain-language summary. This document covers this website only — vibepoints.app. It applies when you browse the site, submit a merchant or driver application, or use a booking link a participating merchant has shared with you. It does not cover the VibePoints mobile app, which has its own, more detailed Consumer, Merchant, and Driver Terms covering the Shells and Vibe+ loyalty programmes, ride bookings, and the Vibi AI assistant.
By using this website you agree to these Terms.
1. Who we are
VibePoints is operated by Ashton Amory trading as VibePoints, a sole proprietorship in the Federation of Saint Christopher and Nevis, registered under the Registration of Business Names Act, with principal place of business at Basseterre, Saint Christopher and Nevis (the "Operator", "we", "us", "our"). You are the person using this website ("you", "your").
2. What this website does
This website is a marketing and intake surface. Through it you can: read about VibePoints; apply to become a participating merchant or driver; and, where a participating merchant has shared a booking link with you, request a reservation with that merchant without installing the app. It does not let you earn or redeem Shells or Vibe+, book a ride, or talk to Vibi — those live only in the mobile app.
3. Booking a service through a shared link
- A booking you submit through a merchant's link is a request, not a confirmed reservation, until the merchant accepts it.
- Your contract for the booked good or service is with the Merchant, not with the Operator. The Operator provides the technology that carries your request to the Merchant; we are not a party to it.
- No account is created by submitting a booking, and no payment is taken on this website — you pay the Merchant directly.
- If you supply the same email address to create a VibePoints mobile app account within thirty (30) days of your visit, any Shells or Vibe+ you would have earned are linked to that account automatically. Outside that window, no reward is issued for that booking.
- The Operator is not responsible for the accuracy of a Merchant's availability, pricing, or service description, or for the Merchant's conduct.
4. Applying as a merchant or driver
- Submitting an application through this website is not an offer or acceptance — it is a request for the Operator (or its designated verification partner) to review your business or your driving credentials.
- We may follow up by email, including with a link to a secure verification (KYC) process, before any account is activated.
- You confirm that the information you submit is accurate and that you have the authority to submit it (for a merchant application, on behalf of the business named).
5. Acceptable use
You agree not to, and not to attempt to:
- submit false, fraudulent, or misleading information in a booking or an application;
- use automated tools, bots, or scripts to interact with this website beyond ordinary browsing;
- attempt to bypass or interfere with any rate-limiting, bot-detection, or security mechanism on this website;
- use this website for any unlawful purpose.
We may decline, delay, or reverse a booking or an application we reasonably believe is fraudulent, abusive, or in breach of this Section.
6. Intellectual property
The content of this website — including its text, design, and the VibePoints name and logo — belongs to the Operator or its licensors. You may view and use it for its intended purpose (browsing, booking, or applying); you may not copy, republish, or commercially exploit it without our prior written consent.
7. Third-party services
This website relies on third-party providers to operate — including cloud hosting and database providers, identity-verification providers, email-delivery providers, and bot-protection services. How we share data with them is described in our Website Privacy Policy.
8. Disclaimers
THIS WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. The Operator does not warrant that a Merchant will accept, honour, or respond to a booking request, that any application will be approved, or that this website will be uninterrupted or error-free.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, the Operator's total aggregate liability to you for any claim arising out of or in connection with your use of this website will not exceed one hundred United States dollars (USD 100). The Operator will not be liable for any indirect, incidental, or consequential loss. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Changes to these Terms
We may update these Terms from time to time. We will bump the version number shown at the top when we do. Continued use of this website after a change is posted constitutes acceptance of it.
11. Governing law and disputes
These Terms are governed by the laws of the Federation of Saint Christopher and Nevis. Please contact us first at tony@vibepoints.dev so we can try to resolve any dispute informally. Unresolved disputes are subject to the courts of Basseterre, Saint Christopher and Nevis.
